Terms of Service

These terms govern your use of the Safely app and website. By using Safely, you agree to them. They are written plainly — read before you accept.

1. The service

Safely is a location-sharing app for families. It lets members of a family group share their location and receive arrival alerts. It is a communication tool, not a safety guarantee.

2. Your account

You sign in with Apple. You are responsible for keeping your device secure. If you lose access, you can restore it by signing in with the same Apple ID on a new device.

3. Acceptable use

You agree to use Safely only with the consent of the people whose location is being shared. Sharing another person's location without their knowledge or consent is prohibited and may be illegal where you live. You will not use Safely to stalk, harass, or harm anyone.

4. Subscriptions & payment (Apple auto-renewal disclosure)

  • Safely offers a Weekly subscription at $9.99 and an Annual subscription at $39.99, prices in USD (equivalent local currency outside the US).
  • Both subscriptions start with a 3-day free trial.
  • Payment is charged to your Apple ID account at confirmation of purchase and at the start of each new billing period.
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the current period ends.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price unless a price change has been communicated in advance.
  • You can manage and cancel subscriptions anytime by going to your App Store account settings after purchase.
  • No refund is provided for the unused portion of the subscription period after a cancellation, except where required by law.

5. Refunds

Refunds are handled by Apple under the App Store policy. Request a refund at reportaproblem.apple.com. We cannot issue refunds directly.

6. Intellectual property

Safely, the Safely name, the lighthouse Beacon mascot, and the app's design are owned by us. You may not copy, modify, distribute, or reverse-engineer the app without written permission.

7. Third-party services

Safely integrates with Apple (Sign in with Apple, StoreKit, MapKit), Supabase (backend), and Vercel (website). Their terms apply to data they process on our behalf.

8. Disclaimer — not an emergency service

Safely is not a replacement for emergency services. Location data can be delayed, inaccurate, or unavailable due to device, network, or environmental conditions. In an emergency, always call your local emergency number immediately. Do not rely on Safely for life-safety situations.

9. Limitation of liability

To the maximum extent permitted by law, Safely and its creators are not liable for indirect, incidental, consequential, special, or exemplary damages arising from your use of the app, including damages for loss of profits, goodwill, data, or other intangible losses. Our total liability for any claim related to the app will not exceed the amount you paid us in the 12 months before the claim.

10. Warranties

Safely is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or always accurate.

11. Termination

You can stop using Safely at any time by uninstalling the app and deleting your account. We can suspend or terminate accounts that violate these terms.

12. Governing law

These terms are governed by the laws of Mexico. Disputes will be resolved in the courts of Mexico City, except where local consumer law gives you a different right.

13. Changes

We may update these terms. Significant changes will be announced in the app. Continued use after the effective date means you accept the new terms.
